Important Warning for Mobile Phone Subscribers

The Department of Telecommunications (DoT) has issued an urgent warning to mobile phone users, indicating that they may face serious legal actions, including court appearances and hefty fines, if a SIM card registered in their name is misused for cyber fraud or other illegal activities. A key part of this warning is that this liability will stand even if the original subscriber never actually used the connection.

Key Activities Leading to Prosecution

Subscribers are particularly cautioned against engaging in several activities that could lead to prosecution. These actions include using phones where the International Mobile Equipment Identity (IMEI) number has been intentionally altered or tampered with. The department further highlighted the risks associated with acquiring SIM cards through deceptive means, such as submitting false documents or impersonating someone else. Crucially, citizens must refrain from transferring or providing their legally obtained SIM cards to anyone else, as this is the easiest way to facilitate complex cyber crimes.

New Telecommunications Act, 2023

This serious warning is reinforced by the recently enacted Telecommunications Act, 2023, which has implemented stricter penalties for these types of activities. Tampering with telecommunication identifiers or becoming involved in SIM card fraud can now lead to significant legal repercussions. The Act outlines penalties that include possible imprisonment for up to three years and hefty fines that can soar to ₹50 lakh. This legislation ensures that individuals who initially acquired the SIM card could be held liable as offenders if the card is misused afterward.

Utilising Available Tools for Risk Management

To help the public mitigate risks, the DoT encourages citizens to make use of the government’s Sanchar Saathi portal or mobile application. This resource enables subscribers to quickly verify all connections registered under their name and to confirm the legitimacy of a device’s IMEI number, thus contributing to a more secure digital landscape for everyone.
