Wikimedia Foundation Appeals Delhi High Court Ruling
The Wikimedia Foundation, which operates Wikipedia as a non-profit, has filed an appeal against a recent Delhi High Court judgment mandating the deletion of content considered defamatory from the Wikipedia page of the Indian news agency ANI, as reported by Reuters. This development is part of a rising trend of legal challenges that global technology companies are encountering in India.
Delhi High Court’s Defamatory Ruling
The High Court determined last week that the material on ANI’s Wikipedia page, which labelled the agency as a “propaganda tool” for the government, was defamatory and damaging to its professional standing. This order was issued in response to a defamation lawsuit initiated by ANI in 2023.
ANI’s Demands and Ongoing Legal Proceedings
The court stated that “the impugned statements are…defamatory and tarnish the professional reputation of ANI.” ANI has sought an apology along with ₹2 crore (approximately $240,000) in compensation from Wikimedia, as reported by Reuters. The legal proceedings are still active within the court system.
According to two insiders familiar with the situation, Wikimedia has subsequently lodged an appeal against this ruling and requested a session before a larger panel of the same court. The court’s website verified that the appeal has been filed, although it did not provide additional specifics. The case, which was briefly addressed on Monday, has been postponed to an undisclosed future date.
Implications for Content Moderation in India
This case highlights the escalating examination of tech platforms by Indian courts regarding their content moderation practices and claims of defamation. As a community-edited platform, Wikipedia often navigates the complexities of free expression and reputation management, especially within politically sensitive contexts.
Wikimedia’s legal challenges reflect a similar ongoing case involving the social media platform X (previously known as Twitter), which is contesting directives from the Indian government to remove posts linked to the 2021 farmers’ protests.
