Google Settles Antitrust Case with ₹20.24 Crore Payment

Google is set to pay ₹20.24 crore to resolve a prolonged antitrust case initiated by the Competition Commission of India (CCI) concerning alleged anti-competitive conduct in the Android TV marketplace. This settlement represents the inaugural resolution under India’s updated Competition Act, which introduced provisions for negotiated settlements in 2023.

Background of the Antitrust Case

The case was launched in 2021 following a complaint that raised concerns regarding Google’s bundling of its Play Store and Play Services on Android smart TVs. Subsequently, the regulator commenced a comprehensive investigation into the tech giant’s operations in this area.

Details of the Settlement Agreement

On Monday, the CCI announced that it had approved Google’s settlement proposal after assessing the company’s commitments outlined in a revised “New India Agreement.”

According to the stipulations of the agreement, Google will now provide a standalone licence for the Play Store and Play Services that is specifically tailored for Android smart TVs in India. This adjustment removes the prior obligation for original equipment manufacturers (OEMs) to bundle Google applications or adhere to default placement stipulations.

Changes to Compatibility Policies

The CCI has also highlighted a notable alteration in compatibility policies. By eliminating the requirement for valid Android Compatibility Commitments (ACC) for devices imported into India that do not come with Google applications, OEMs are now empowered to market and develop non-compatible Android devices without breaching the Television App Distribution Agreement (TADA).

This change is anticipated to provide OEMs with enhanced flexibility in the design and distribution of smart TV products in India, potentially cultivating a more competitive market atmosphere.
