Reddit Challenges Australia’s New Law on Social Media Access for Under-16s

Reddit has initiated a legal challenge in the High Court of Australia, aiming to overturn the newly implemented law that prohibits social media access for users younger than 16 years. This US-based platform, which considers Australia a key market, lodged its lawsuit shortly after the significant legislation was enacted, making Australia the first nation globally to impose such an age limitation.

Legal Argument against the Age Restriction

The foundation of Reddit’s legal stance is that the law infringes upon Australia’s constitutionally implied freedom of political communication. The platform argues that limiting access for users under the age of 16 restricts their capability to participate in political discussions and form informed opinions. This, they assert, negatively impacts the political communication crucial for current and future voters, including parents and educators.

Details of the Legislation

This legislation, which came into effect on 10th December, requires platforms like Reddit, Instagram from Meta, and TikTok to take “reasonable steps” to block under-16 users, or face hefty fines that could escalate to A$49.5 million (around Rs 447 crore). Although Reddit has announced its intention to comply with the law by adopting age-verification techniques, including methods for age estimation and inference, the company insists that the statute is fundamentally flawed.

Concerns Over Privacy and Data Collection

Reddit contends that the necessary age verification processes, which could entail invasive data collection techniques such as facial recognition, create significant privacy and political expression concerns for all internet users, including adults. Additionally, Reddit has requested to be entirely exempt from the ban, arguing that its primary focus is on knowledge-sharing and community engagement rather than conventional real-time social networking, meaning it should not be classified as an ‘age-restricted’ platform under this legislation.

Defendants of the Case

The lawsuit names the Commonwealth of Australia along with Communications Minister Anika Wells as the defendants. The government has remained resolute, with a spokesperson asserting that the Albanese administration is “on the side of Australian parents and kids, not platforms,” and is ready to confront the legal challenge to safeguard young Australians from online dangers. Reddit’s lawsuit represents the second High Court challenge against this ban, following a prior challenge filed by two teenagers the previous month.
