Anthropic Legal Challenges: Pentagon Blacklist and National Security Risks

The US government is also contesting a lawsuit by Anthropic, which aims to overturn the classification that designates the company as a national security supply chain risk.

National Security Supply Chain Risk Designation

The designation as a supply chain risk was formalised on March 3, following Anthropic’s refusal to meet demands set by the Pentagon. Dario Amodei, the CEO of Anthropic, has expressed that their AI model, Claude, will not be employed for mass surveillance of US citizens and will not be integrated into autonomous weapons systems.

Legal Arguments and Free Speech Claims

The court documents point out that Anthropic is unlikely to succeed in their argument claiming that the US government’s actions violate the speech protections provided under the First Amendment of the Constitution. The filings indicated that the matter arises from contractual issues, rather than a concerted effort to inhibit free speech.

The statement revealed that it was only after Anthropic declined to lift restrictions on the use of its technology, an act considered conduct rather than protected speech, that the President instructed all federal agencies to sever their business ties with Anthropic.

Support from Legal Experts and Tech Community

A number of legal experts are in support of Anthropic, asserting that they possess a solid case against the government’s actions. The company has also begun reviewing the government’s court filing.

Anthropic noted through Reuters that seeking judicial review does not alter their commitment to leveraging AI for national security purposes, while emphasising that this is a crucial measure to safeguard their business interests, as well as those of their customers and partners.

Tech Industry Response

While Anthropic and the US government are locked in this significant legal confrontation, numerous tech professionals from leading companies such as OpenAI and Google have submitted an amicus brief in favour of Anthropic. This brief argues that the government’s label represents an improper and arbitrary exercise of authority.
