Crypto Reporting Framework Guidance by CBDT

The Central Board of Direct Taxes (CBDT) has released a comprehensive guidance note outlining how crypto exchanges and virtual digital asset (VDA) service providers must adhere to India’s latest crypto reporting framework as per the Income-tax Rules, 2026. This guidance offers clarity on the newly established reporting obligations and aligns India’s framework with the OECD’s Crypto-Asset Reporting Framework (CARF).

New Reporting Framework Requirements

Under this new framework, crypto exchanges and other Reporting Crypto-Asset Service Providers (RCASPs) are mandated to gather additional details from users, including their tax residency status and Taxpayer Identification Number (TIN), where applicable. Additionally, these entities are required to maintain comprehensive transaction records and submit annual reports to the Income Tax Department.

Operational Guidelines

The guidance elaborates on how exchanges should identify users who need to be reported, ascertain the account holder in various situations, and manage cross-border transactions that may involve reporting obligations in multiple jurisdictions. Moreover, there is a clear distinction between crypto-assets, central bank digital currencies (CBDCs), and specific electronic money products for reporting needs.

Impact on Compliance Systems

This clarification is anticipated to assist crypto exchanges in preparing their compliance systems ahead of the enforcement of reporting rules. Industry players will need to enhance their Know Your Customer (KYC) and record-keeping practices to align with these new mandates.

No New Tax Imposed

While this guidance does not introduce any additional tax on virtual digital assets, it establishes the operational framework for reporting crypto transactions and communicating information with tax authorities.

Significance for India’s Crypto Industry

For India’s crypto sector, this recent guidance signifies another move towards a more regulated landscape. Exchanges will now be required to invest in compliance infrastructure to ensure that customer onboarding and reporting processes match the expectations set forth by the CBDT under this new framework.
